Agreement to terms
By accessing or using OnTheDot's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services and plans
OnTheDot provides website design, development, hosting, and maintenance for a monthly subscription fee. Your plan determines which features are included. Lower plans cover your website, hosting, SSL, and ongoing support. Higher plans also include a CRM dashboard for managing your leads, customers and jobs, together with automated follow-up messaging sent on your behalf (see 'Automated messages on your behalf' below). You can run a website with us without the CRM. Some features, such as the AI chat widget and online payments, may be optional or depend on your plan.
Payment terms
Subscriptions are billed monthly. By subscribing, you authorise us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and your service will continue until the end of your current billing period.
Domain names
Where your plan includes a domain, we register a standard, available domain name on your behalf and you are recorded as its owner (the registrant). We act as the technical contact and manage its DNS while you are subscribed. Premium or aftermarket domain names (names already held by a third party and offered for resale) are not included; if you want one, its additional cost is quoted and paid separately. Because you own your domain, you can take it with you: on cancellation we release control to you or transfer it at your request.
Cancellation and leaving us
You may cancel at any time by contacting us. Your website stays live until the end of your current billing period, followed by a short grace period. We don't lock you in. On request during that period we provide an export of your website as static files you can host anywhere, a copy of your site content, and, if you use the CRM, an export of your leads, customers, and jobs. We also release or transfer your domain to you. After the grace period your website is taken offline and removed from our platform.
Your content
You retain ownership of all content you provide for your website, including text, images, and logos. You grant us a licence to use this content solely for the purpose of providing our services to you, and you can request a copy of your content at any time.
Acceptable use
You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. We reserve the right to refuse or terminate service for any content we deem inappropriate or illegal.
Automated messages on your behalf
If your plan includes the CRM, we can send automated text messages (SMS) and emails to your leads and customers on your behalf, such as follow-ups, booking reminders and review requests. The cost of these messages is included in your subscription, within a fair-use allowance (a set number of texts per business each month); we will get in touch before making any change if you consistently exceed it. Messages are sent under your business name. You are responsible for only adding contacts you have a genuine, lawful reason to contact, and for complying with the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth): every message identifies your business and offers a way to opt out, and we honour opt-outs and stop messaging anyone who unsubscribes. You can switch automated messaging off at any time.
Service providers we use
To deliver the service we rely on trusted third-party providers who process data only to provide their part of the service: Twilio (text messaging), Resend (email), Stripe (payments, where enabled), and our hosting and database providers. We do not sell your data. See our Privacy Policy for more detail on how your data and your customers' data are handled.
Support and account access
To provide support, maintain the service, and protect its security, authorised OnTheDot personnel may access your account and data, including viewing your dashboard as your business. This access is limited to legitimate operational purposes, is recorded in an internal audit log, and is shown by a clear banner while active. We never access your password. Limitation of liability
OnTheDot shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of our services. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
Changes to terms
We may update these terms from time to time. We will notify you of any material changes by posting the new terms on our website. Your continued use of our services after such changes constitutes acceptance of the new terms.
